Battle Looms in Washington Over Asbestos Litigation Bill
Lobbyists pushing the asbestos compensation fund face an uphill battle this coming week on Capitol Hill. Prospects look grim regarding the bill even making it to the US senate for a vote.
San Diego CA (PRWEB) February 7, 2006 -- Lobbyists pushing the asbestos compensation fund face an uphill battle this coming week on Capitol Hill. Prospects look grim regarding the bill even making it to the US Senate for a vote.
The Bill S.852 - the Fairness in Asbestos Injury Resolution Act of 2005 would create a $140 billion fund to finance settlements to be put aside for victims of mesothiolma cancer. The bill made it through the Senate Judiciary Committee approximately 9 months ago.
One roadblock to passage is they may not have the 60 votes needed to break a filibuster that could delay or prevent the fund coming into operation. Opponents to the bill argue that adding government involvement would be unjust to the many victims suffering from Mesothelioma due to asbestos exposure.
A valid concern for the victims is that should the fund run out of money their options for compensation would be limited.
Several other obstacles await the bill’s progress should it be able to obtain the 60 additional votes needed in the Senate. The House of Representatives have a substantially different bill along with potential Constitutional challenges should the bill pass.
Judd Gregg, the chairman of the Senate budget committee, stated he would raise budget point of order – which requires another 60 votes to move the bill to its next step.
To move the bill to the Senate Floor looks to be an insurmountable obstacle at this point in time.
